Welcome to Nieuro. By downloading, accessing, or using the Nieuro application ("App") or any related services (collectively, the "Service"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, do not use the Service.
You must be at least 13 years old to use the Service. By using the Service, you represent and warrant that you meet this age requirement and that all registration information you provide is accurate, current, and complete.
You must create an account to access most features of the Service. You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account at support@nieuro.net. We reserve the right to terminate accounts that violate these Terms.
Certain features of the Service require a paid subscription ("Nieuro Premium"). The following terms apply:
The Service uses artificial intelligence to generate podcast episodes, host conversations, journal insights, mantras, and other content. By using the Service, you acknowledge and agree that:

All content, trademarks, logos, service marks, trade names, and technology comprising or embodied in the Service are owned by or licensed to Nieuro. You are granted a limited, non-exclusive, non-transferable, revocable license to use the Service for personal, non-commercial purposes in accordance with these Terms. You may not reproduce, distribute, modify, create derivative works from, publicly display, or exploit any content from the Service without our prior written permission.
Journal entries and other content you create in the Service remain yours. By storing content in the Service, you grant us a limited, non-exclusive license to process, store, and display it solely for the purpose of providing the Service to you. We will not use your personal journal entries to train AI models or share them with third parties except as described in our Privacy Policy.
Your use of the Service is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to the practices described in our Privacy Policy.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ACCURACY. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, NIEURO AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND LICENSORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, PROFITS, REVENUE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO YOUR USE OF OR INABILITY TO USE THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.
You agree to indemnify, defend, and hold harmless Nieuro and its officers, directors, employees, agents, and licensors from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with your access to or use of the Service, your violation of these Terms, or your violation of any third-party rights.
We reserve the right to suspend or terminate your account and access to the Service at any time, with or without notice, for any reason, including violation of these Terms. You may delete your account at any time via Settings → Delete Account in the App. Upon termination, all licenses granted to you will immediately cease.
These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles. Any disputes arising under or relating to these Terms or the Service shall first be attempted to be resolved informally by contacting us at support@nieuro.net. If informal resolution fails, disputes shall be resolved through binding arbitration in accordance with the American Arbitration Association rules.
We may modify these Terms at any time. We will notify you of material changes via the app or email and update the "Last Updated" date. Your continued use of the Service after changes are posted constitutes your acceptance of the revised Terms. If you do not agree to the revised Terms, you must stop using the Service.
If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that these Terms will otherwise remain in full force and effect.
